General business conditions

• Scope of application

  Your Deichmann order is subject to the following General Business Conditions of Deichmann SE, Essen, in the version valid when you placed your order.

  Here you will find only the General Business Conditions applying to contracts/orders effected in the Deichmann online shop. You can download or print the text on your computer.

• Contract/order

  Our data on goods and prices during the ordering process are non-binding and subject to change.

  Contracts through this portal can only be concluded in the German language.

  You provide a binding offer to Deichmann SE when you have gone through the online ordering process by entering the data requested there and clicked on the “Place order” button in step 4. After you have placed your order, we send you an e-mail that confirms our receipt of your order and lists its details (receipt confirmation). This receipt confirmation does not represent acceptance of your order but merely informs you that your order has been received.

  No purchase contract takes place until we dispatch the ordered product to you. You can monitor the status of your order in the “My Account” area under “Your Orders”.

  The minimum age for ordering from the online shop is 18 years. Orders are limited to €400.00. If the total of open invoices from previous orders from us reaches the €400.00, no further orders are possible until these invoices have been paid.

• Storage of the contract text / storage of your order data

  Your order data are stored at Deichmann SE. If you would like to have them in printed form, you can print out the order confirmation. This appears on your screen after you have placed your order. If you have given us your e-mail address, you will also receive all relevant data on your order in an e-mail that can also be printed.

• Handling and delivery

  Dispatch is handled by our delivery partners UPS (Mon.-Fri.) and Hermes (Mon.-Sat.) exclusively to delivery addresses within Germany. With Hermes, delivery is also available to Hermes parcel shops. Delivery is not made to parcel stations.

  Delivery fees are assumed to a large extent by Deichmann SE.
  We bill you for only a flat portion of the delivery costs amounting to €1.50. For an order totalling less than €10.00, we levy a minimum order charge of €2.50, so that in such cases delivery costs amount to a total of €4.00.

  For COD payments, we levy a COD charge of €2.50.
  Considering the minimum order charge and the COD charge, the maximum total delivery charges can amount to €6.50.

  Generally, delivery is made within 48 hours (from the next business day).

• Maturity and payment/retention of title

  Payment can be made by credit card (Visa, MasterCard, American Express), Giropay, PayPal, cash on delivery or instant bank transfer through sofortuebweisung.de. All prices are in EUROS, include the legally binding VAT, currently amounting to 19%, and do not include applicable delivery costs. The valid price is the price at the time of the order. In individual cases, we reserve the right to adjust the choice of payment methods. Until payment is completed, the goods remain the property of Deichmann SE.

• Warranty

  The legal warranty obligation is 2 years according to Section 437 of the German civil code (BGB) and begins upon delivery of the goods. During this time, all deficiencies subject to the legal warranty obligation are remedied free of charge. The legal provisions apply to the warranty. Warranty claims are void for damage due to improper treatment or use of the goods sold.

  If there are deficiencies, you can return the ordered goods at any time to our local Deichmann shops (just use our location finder to locate your nearest shop) or use our free hotline: 0800 / 50 20 500. Deichmann will exchange your ordered goods for a new item, or if you wish, refund you the purchase price.

• Cancellation instructions

  Cancellation / returns
  You can cancel your contract within two weeks in text form (such as letter, fax or e-mail) without stating any reason, or by returning the item. The period begins after receipt of the notification in text form, but not before the goods have reached the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and not before fulfilment of our obligations according to Section 312 e Para. 1 sentence 1 BGB in connection with article 246 of Section 3 EGBGB. Timely dispatch of cancellation, of the goods or of the return claim is sufficient to ensure the cancellation period. In all cases, return delivery is made at our cost and risk.

  Consequences of cancellation
  In the event of a valid cancellation, the mutually received services are to be granted back, and if necessary, received benefits (e.g., interest) must be released. If you can only return the received services to us in a fully or partially damaged state, you must pay us compensation for the value. When goods are transferred, this does not apply if the damage to the items is attributable exclusively to their examination as it could occur in a physical shop.

  In addition, you can avoid the obligation of compensation of value for damage caused by proper use of the goods by not using the item as your own property and by avoiding anything that would affect the value. Items that can be sent in packages must be returned to us at our cost and risk or delivered to a Hermes parcel shop. Items that cannot be sent in packages will be picked up at your premises. Obligations to reimburse payments must be fulfilled within 30 days. For you the period begins with dispatch of your cancellation notice or the item, and for us with its receipt.

  Additional requests
  For exercising your cancellation rights, use our free hotline 0800 / 50 20 500 (Mon.-Fri., 9 a.m. to 9 p.m., Sat. 9 a.m. to 6 p.m.) or report the return in the “My Account” area under “Your Orders (the “return” function is available only after the goods have been delivered) to get a return label for free return delivery.

  Instead of sending the goods back to the address above, you can also take them back to one of our local Deichmann shops within the cancellation period (just use our location finder to find the shop nearest you). Then the purchase price will be refunded to you right in the shop.

  When returning your purchase, please use, if possible, the original shoe box and enclose the completed return slip. . To prevent later claims for reimbursement of services, please check the goods carefully and do not damage them (e.g., no scratches, grease streaks, worn soles, etc.). Data protection

• Collection, storage and usage of personal data

  Personal data concerns information, which can identify you, in particular name, date of birth, email address or postal address. Deichmann SE (Deichmann) only stores your personal data if you have made your data explicitly available and have given your express consent concerning its concrete usage, for example within the scope of subscribing a newsletter, participating in surveys, prize draws or competitions, during the course of the order process or other contact queries.
  
  We only store and use your personal data – or pass it on – in accordance with your consent resp. to the extent necessary in a special individual case. For example to answer your questions or requests, to provide you with the newsletter you requested or with information about the result of prize draws or competitions and to realise your online purchase.
  
  In order to do this, Deichmann might have to forward your personal data to other companies within the Deichmann Group or to external service providers for further data processing. Such service providers for example might have been instructed to send our newsletter to you or process competitions. Deichmann requests from its external service providers that these process your personal data exclusively in conformity with our conditions and in agreement with this Data Privacy Statement and the Federal Data Protection Act.
  
  Data protection and use of Facebook
  These internet pages use plugins of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). Calling up internet pages of our website equipped with such a plugin establishes a connection to the Facebook servers, whereby the plugin will be displayed on the internet page by communicating with your browser. This tells the Facebook server which of our internet pages you have visited.
  If you have been logged in as a Facebook member, Facebook will assign this information to your personal Facebook user account. Using the plugin functions (e.g. clicking the “Like” button, making a comment), this information too will be assigned to your Facebook account.  If you do not want Facebook to collect data concerning you via our website, you have to log out of Facebook prior to visiting our website.
  
  We have no influence on the extent of data, which Facebook collects with the help of this plugin and therefore inform you in accordance with our state of knowledge.
  You will find more detailed information on the collection and usage of data by Facebook and on your relevant rights and options to protect your privacy in the data protection information provided by Facebook.
  
  When using Facebook, technically necessary data of the user are transferred to Facebook. All activities, which the user carries out within the portal can be seen and tracked by Facebook.
  Deichmann guarantees that your personal data will not be sold or leased to third parties. However, we reserve the right to disclose information about you if we are legally required to do so or if we are required to do so by legally acting or law enforcement authorities.

  Provided you expressly agree to further utilisation of your personal data for general “advertising and market research purposes”, e.g. by explicitly clicking on a relevant button within the scope of actions on our websites, your personal data will also be stored and used for such purposes.
  
  We are then able to send you advertising concerning our products or other offers of our company or suggest to you the participation in prize draws or competitions. We will contact you using those communication channels, you inform us about in connection with your consent, for example by email, when you provide us with your email address. By phone, SMS or mobile application via App, when you provide us with your mobile number. By white mail when you give us your address.
  
  Please let us have your postal address when you place an online order or register
  By accepting our data protection provisions, you provide us with the opportunity of sending you information about our products per mail via our online shop. Should you not be interested in receiving our mail, you can unsubscribe from this service by selecting ‘Unsubscribing from  mail’ via our contact form. It may be that we use your data to create and maintain a user profile to provide you with individualised advertising, which we believe might be of special interest to you.
  
  If you expressly agree to the utilisation of your personal data for general “advertising and market research purposes”, we might use your data also for analysis purposes and for improving the effectiveness of our websites, our advertising and market research as well as our other marketing and sales efforts.

  Deichmann uses standard security measures via your browser - the so-called SSL Encoding.

  o How do we protect our personal data?
  
  If you place an order, we are receiving your personal data. To ensure, that this data does not get into the wrong hands, we encode it with the SSL process. This is currently the most common and securest transfer procedure on the internet. It is always used whenever sensible data is transferred
  
  o SSL (Secure-Socket-Layer)
  
  The SSL (Secure-Socket-Layer) process protects data, which a customer sends to a server of the company via the internet. SSL guarantees triple protection:
  
  - All details, which are to be transmitted, are encoded.

  - It will be checked whether data reaches its relevant recipient in a complete and unchanged form.
